We will not be responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete Personal Data that you provide to us.

For how long do we retain your personal data?

Your personal data will be deleted when it is no longer reasonably required for the Permitted Purposes or you withdraw your consent (where applicable) and we are not legally required or otherwise permitted to continue storing such data. We will, in particular, retain your personal data where required for Usedful to assert or defend against legal claims until the end of the relevant retention period or until the claims in question have been settled.

Your rights

Subject to certain legal conditions, you have the right to request a copy of the personal data about you which we hold, to have any inaccurate personal data corrected and to object to or restrict our using your personal data. You may also make a complaint if you have a concern about our handling of your personal data.

We may request that you prove your identity by providing us with a copy of a valid means of identification in order for us to comply with our security obligations and to prevent unauthorised disclosure of data. We reserve the right to charge you a reasonable administrative fee for any manifestly unfounded or excessive requests concerning your access to your data, and for any additional copies of the personal data you request from us.

We will consider any requests or complaints which we receive and provide you with a response in a timely manner. If you are not satisfied with our response, you may take your complaint to the relevant privacy regulator. We will provide you with details of your relevant regulator upon request.

Updates to this Privacy Policy

This Privacy Policy was last updated in September 2018. We reserve the right to update and change this Privacy Policy from time to time in order to reflect any changes to the way in which we process your personal data or changing legal requirements. In case of any such changes, we will post the changed Privacy Policy on our website or publish it otherwise. The changes will take effect as soon as they are posted on this website.

1. Prices

VAT: Prices quoted do not include VAT. VAT is chargeable to all UK and EU (European Union) customers. UK taxes are not chargeable to any customer outside of the EU. Customers based outside of the EU may have to pay import duty in their own country.

Currency: All prices are in Euros, but Usedful may agree to be paid in a different currency.

2. Shipping

An electronic signature is required from the seller before an order can be placed. This verifies the identity of the seller and establishes their agreement to these Terms and Conditions.

The seller agrees to ship equipment (insured) to the buyer (at the buyer’s expense) upon notification that payment has been received by Usedful. Usedful does not accept cheques, credit cards or any types of non-cash payment. Payment is made to the seller by bank transfer upon receipt and approval of equipment by the buyer less any commission payments due to Usedful.

All equipment purchased through Usedful is shipped with all charges forward including insurance or prepaid by the buyer who can arrange collection by their own shipper. The buyer is responsible for all shipping costs. All equipment must be fully insured by the buyer before shipment.

The seller agrees to package equipment safely for delivery to the buyer. Please Note: Liability is with the seller and the carriage company for damage caused as a result of insufficient packing and/or damage incurred in transit to the buyer. The seller agrees to repair or replace goods, or refund full purchase price (and shipping costs) if notified of a defect by the buyer via Usedful due to improper packing. Safe packing is very important in order to avoid return of equipment.

The buyer should notify Usedful of any transit damage which has occurred immediately. Th buyer should check all equipment upon delivery and initiate any damage claims immediately with the seller.

3. Equipment Condition

All equipment should be in full working order unless otherwise indicated. The condition of the equipment will be stated as the seller has represented it to us. All used equipment should be in good working order (unless otherwise stated by the seller in advance).

By allowing Usedful to sell the equipment, the seller confirms that it holds the legal title to the equipment that it is selling, that the equipment is free from any and all financial encumbrances, is in satisfactory working order (unless otherwise stated) and that the condition of the equipment is described and listed accurately to the best of the seller’s knowledge.

The seller should inform Usedful of any of the following to the status of the equipment for sale on their behalf: change in price, condition and availability.

The seller is responsible for return freight costs if the condition of the equipment does not match the description provided by the seller to Usedful in advance of any sale.

4. Returns

Buyers have 3 days to fully check and test the equipment. The equipment must be checked and tested indoors. If there are any problems, Usedful must be notified within 3 working days of receipt of the equipment. All conditions listed or given for the equipment for sale are to the best of our knowledge. Return freight (insured) is the responsibility of the buyer. The seller is only liable for return freight if one of the following applies:

  1. Equipment is damaged due to improper packaging.
  2. Condition of goods is NOT as described by the seller.
  3. Equipment is not in working order as described by the seller.

No refunds will be given before equipment has been delivered.

5. Cancellations

Usedful reserves the right to cancel an order at any time without prior notice. We will attempt to inform the buyer the soonest possible by email.

In the case of buyers wanting to cancel an order, they are required to contact our sales department as soon as possible.

6. General

All parties should at all times comply with all national and international laws.

Any notice given by Usedful to another party to a buyer or a seller will be in written form and delivered either by post or by email.

These Terms and Conditions (together with the documents referred to in them) constitute the entire agreement between Usedful, the buyer and the seller and supersedes any previous agreement between them.

These Terms and Conditions do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of their terms.

If any provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable in any respect under the law of any jurisdiction:

  • the validity, legality and enforceability under the law of that jurisdiction of any other provision; and
  • the validity, legality and enforceability under the law of any other jurisdiction of that or any other provision,

will not be affected or impaired in any way thereby.
